Abstract:
This geospatial dataset shows the Mexican Spotted Owl critical habitat units in its canyon and forest habitats across Arizona, Colorado, New Mexico, and Arizona. The owl inhabits canyon and forest habitats across a range that extends from southern Utah and Colorado, through Arizona, New Mexico, and west Texas, to the mountains of central Mexico. We published a final rule listing the owl as a threatened species on March 16, 1993 (58 FR 14248). For more information on the previous critical habitat designations and other actions related to the owl, refer to the final rule published in the Federal Register on February 1, 2001 (66 FR 8530). On January 13, 2003, the United States District Court for the District of Arizona, (Center for Biological Diversity v. Norton, Civ. No. 01-409 TUC DCB), ruled that our February 1, 2001 final designation of critical habitat for the owl violated the Endangered Species Act, as well as the Administrative Procedure Act (5 U.S.C. 551 et seq.). On November 12, 2003, the United States District Court for the District of Arizona, (Center for Biological Diversity v. Norton, Civ. No. 01409 TUC DCB), ordered the Service to submit a new final rule for designation of critical habitat for the owl to the Federal Register by August 20, 2004. Pursuant to this court order, on November 18, 2003 (68 FR 65020), we reopened the public comment period on our July 21, 2000, proposed rule to designate critical habitat for the owl (65 FR 45336). The proposal included approximately 5.5 million ha (13.5 million ac) in Arizona, Colorado, New Mexico, and Utah, mostly on Federal lands. We have prepared a new final designation in compliance with this Court order. This new designation is based upon maps that were included in our July 21, 2000 proposed rule. We refined the maps delineating the boundaries of critical habitat for the owl after considering public comments and information received from a variety of sources including the US Forest Service (FS), US Bureau of Land Mangement (BLM), and State agencies. The new designation is based on the best available scientific and commercial data, public comments, and current policy. As noted in the final rule, the textual unit descriptions constitute the legal source for determining the critical habitat boundaries. The areas included within the boundaries of the GIS file do not follow the legal boundaries of the critical habitat designation. See USE CONSTRAINTS for further information.

Supplemental_Information:
Critical habitat are areas considered essential for the conservation of a listed species. These areas provide notice to the public and land managers the importance of these areas to the conservation of this species. It does not afford any special protection or restriction other than where federal funding, permits, licenses, authorizations, or actions occur or are required.

Additionally, interested parties are encouraged to contact the Service for a definitive finding of whether a location is within critical habitat (See Technical/Consultative Contacts:).

This geospatial dataset is the final critical habitat units layer for Mexian Spotted Owls. These data are to be used only in the context of the definition and purpose of critical habitat. This primarily relates to Section 7 consultation under the Endangered Species Act. These data may be used for planning and land management purposes. They are not to be used for legal survey use.
